2007 law rules that increases can only come in second year of pension
‘New’ pensioners do not qualify for this year’s pension increases, because of a law dating back to 2007 which rules that increases can only come in the second year of payments.
What this means is that someone who started receiving their pension in 2023, will only start receiving increases due in 2025.
A new movement, JPR Justiça (standing for Justice for Pensioners and the Retired) is determined to correct this anomaly “forever”.
Say reports today, it has requested meetings with President Marcelo, with the new prime minister and all political parties.
Considering the multiplicity of pressing issues awaiting a new government that cannot even elect its choice for the president of parliament, it is unclear when JPR Justiça’s claims might be dealt with – particularly as if the ‘injustice’ is considered valid, there could be a case for ‘retroactive payments’ to almost a million pensioners potentially discriminated against since 2007.
For now, a formal complaint has been lodged with Ombudsman Maria Lúcia Amaral. JPR Justiça is also maintaining that the 2007 law is ‘unconstitutional’ in that it penalises people who have worked all their lives, and paid into the system in the belief that they would be treated ‘fairly’.
JPR Justiça formed in January, “exclusively to repair this injustice”, writes Correio da Manhã. It already has a petition in favour of its cause being shared online.
