While one EDP case got off to a shambolic start after 12 years earlier this week, the other case that has been in and out of the tabloids, saw defendants score a major victory today – a situation that could have implications for other cases (stacked up in the country’s dense judicial backlog). Basically, the seizure of emails which constitute “one of the main pieces of evidence in the investigation of this case” has been annulled by 15 judges of the Supreme Court, citing incorrect proceedure. Considering it was this case that spawned the case that HAS got into a courtroom, the likelihood of both ‘ending up in a lake’ (as has been long predicted) has now almost certainly increased.
